Terms & conditions
Preamble
These General Terms and Conditions of Sale ("Terms") constitute a legally binding agreement between STRONG EXISTENCE LDA, a company duly organized and existing under the laws of Portugal, with its registered office at Rua das Macieiras, 89, 2750-010 Cascais, Portugal, and registered under number 514 382 201 ("Seller"), and any natural person or legal entity ("Customer") that places an order for the purchase of goods or services from the Seller.
By placing an order, the Customer acknowledges and agrees that these Terms shall exclusively govern the contractual relationship between the Customer and the Seller, to the exclusion of any other terms or conditions, including those that may appear on the Customer's documents, unless otherwise expressly agreed in writing by the Seller.
The Seller reserves the right to amend or modify these Terms at any time, at its sole discretion. Such amendments or modifications shall become effective immediately upon their publication. However, for any orders placed prior to the effective date of the amendments or modifications, the Terms in force at the time the order was placed shall apply. The Customer is responsible for reviewing the Terms periodically to ensure continued compliance.
Article 1: Purpose
These General Terms and Conditions of Sale are intended to define the contractual terms governing the relationship between STRONG EXISTENCE LDA ("Seller") and the Customer, from the placement of an order through the completion of the sale, including the terms related to payment, delivery, and any applicable after-sales services.
Article 2: Products
The products offered for sale on the Luisa-Paixao website are described and presented with the utmost accuracy. However, STRONG EXISTENCE LDA shall not be held liable for any errors or omissions in the product descriptions, under any circumstances. The photographs and images of the products are provided for illustrative purposes only and do not constitute a contractual representation of the products.
Article 3: Prices
Prices in European Union Countries:
The prices displayed for products available to customers within European Union countries are unit prices, denominated in Euros (€), inclusive of Value Added Tax (VAT). These prices are guaranteed at the time the order is placed, subject to any typographical or printing errors. The prices apply to products paid in full, at the latest, at the time of delivery. They exclude any flat-rate contribution towards delivery and package preparation costs, which are calculated based on the applicable rates at the time the order is placed.
Prices in Non-European Union Countries:
For products shipped to countries outside the European Union, the prices are calculated and presented exclusive of taxes. In such cases, additional charges such as customs duties, import duties, local taxes, or state taxes may apply. These charges are not the responsibility of STRONG EXISTENCE LDA and remain the sole responsibility of the Customer.
Article 4: Order
To place an order on the Luisa-Paixao website, the Customer must follow the process below:
- Add the desired products to the shopping cart.
- Select the delivery country to determine the applicable delivery charges.
- Validate the order by accepting these General Terms and Conditions of Sale.
- Complete the payment using one of the available payment methods.
Upon successful completion of these steps, the Customer will receive, at a minimum, a confirmation of order registration and a confirmation of the dispatch of the order.
The Customer retains the right to cancel all or part of the order without charge before the confirmation of shipment, which will be communicated via email. After receiving the shipping confirmation but before the package is handed over to the carrier, the Customer may still cancel the entire order but will be subject to a $5.50 packing fee (including VAT). Once the package has been handed over to the carrier, cancellation of all or part of the order is no longer possible; however, the Customer retains the right to exercise their right of withdrawal upon receipt of the package.
Article 5: Payment
Payment by Credit Card:
Customers purchasing products on the Luisa-Paixao website may pay using a credit card (including Blue Card, Visa, Eurocard, and MasterCard) by providing the card number (16 digits), expiration date, and the Card Verification Code (CVC) (the last 3 digits located in the signature area on the back of the payment card). Online payments are secured through STRONG EXISTENCE LDA's payment service provider. By submitting their payment information, the Customer authorizes STRONG EXISTENCE LDA to charge the credit card for the specified amount and confirms that they are the legal holder of the card and have the lawful right to use it. If an error occurs, the card cannot be debited, or if fraud is suspected, the sale may be immediately terminated, and the order canceled.
Payment by PayPal:
Customers may also choose to pay via PayPal when making a purchase on the Luisa-Paixao website. In this case, PayPal's general terms of use will apply.
Payment by Apple Pay:
Customers have the option to pay using Apple Pay when purchasing on the Luisa-Paixao website. In such instances, the general conditions of use of Apple Pay will apply.
Article 6: Delivery
Article 7: Retraction for orders delivered in European community
In accordance with Sections L121-20 and following of the Consumer Code, a Customer who is a non-commercial individual has the right to return a product to STRONG EXISTENCE LDA within 14 calendar days from the date of receipt.
How to return products.
The Customer must return the products to STRONG EXISTENCE LDA at Rua das Macieiras, 89, 2750-010 Cascais, Portugal, within 14 calendar days. The products must be returned in their original packaging, unused, in perfect working condition, and with all accessories and instructions, so that they can be resold as new.
Repayment terms and conditions
Subject to the conditions specified above, STRONG EXISTENCE LDA undertakes to reimburse the customer who has exercised his right of withdrawal: the price of the product according to the amount on the purchase invoice. The cost of return remains, in all cases, the responsibility of the customer.
Article 8: Guarantees
Legal Guarantee of Conformity
All products available for purchase on the Luisa-Paixao website are covered by the legal guarantee of conformity as outlined in Sections L211-1 and following of the Consumer Code. This guarantee ensures that products conform to the contract and are free from defects.
Guarantee Against Hidden Defects
All products offered on the Luisa-Paixao website are also covered by the guarantee against hidden defects, as specified in Sections 1641 and following of the Civil Code. This guarantee covers defects not apparent at the time of sale that affect the product's usability.
Contractual Guarantee
In addition to the legal guarantees, all products on the Luisa-Paixao website come with a 2-year contractual guarantee, effective from the date of the invoice. This contractual guarantee does not cover damages resulting from connection errors, power surges, mechanical alterations, drops, misuse, neglect, or other forms of inappropriate handling. It also excludes wear and tear of parts subject to normal use (such as batteries and power cells) or damage resulting from improper use of the product.

Article 10: Personal Data
In accordance with the "Data Protection Act" of 6/01/78, the customer has the right to access, rectify and oppose information concerning him/her. Simply write to STRONG EXISTENCE LDA - Rua das Macieiras, 89 - 2750-010 Cascais - Portugal, indicating your Name, First Name, Address and Customer number.
Article 11: Jurisdiction
In the event of a dispute or claim, the Customer should first contact STRONG EXISTENCE LDA to seek an amicable resolution. If the parties are unable to reach a mutual agreement, the contract shall be governed by and construed in accordance with Portuguese law.
